However, the passenger, Evan Thomas, had different plans and attempted to evade capture by fleeing on foot. Thomas’s escape route involved jumping several fences and even crossing Highway 101 towards Santa Rosa Avenue. Nevertheless, law enforcement persevered and located him in the 2600 block of Santa Rosa Avenue, where he was taken into custody. Upon searching the vehicle, officers made an alarming discovery. In addition to the stolen merchandise from Dick’s Sporting Goods, they found property believed to be stolen from two other businesses, along with burglary tools and items used for concealing stolen goods. The thorough investigation conducted by the Dick’s Sporting Goods security team revealed that Thomas had been responsible for multiple thefts from the store since July 2022, amounting to a staggering $3,185 in stolen merchandise. As a result of their criminal activities, both Lyons and Thomas now face serious charges. Lyons, a 56-year-old transient from Santa Rosa, was arrested and booked on charges including felony organized retail crime theft, felony commercial burglary, misdemeanor possession of burglary tools, and felony violation of post-release community supervision. In 1979, Mena worked diligently as a security guard at a business located at 444 De Guigne Drive in Sunnyvale. Tragically, on October 27th of that year, officers from the Sunnyvale DPS responded to a report of an assault at the business and discovered Mena in the lobby, suffering from multiple stab wounds. For years, law enforcement officials struggled to find leads or suspects in the case, leaving Mena’s family and the community grappling with unanswered questions and unresolved grief. However, in a remarkable turn of events, a DNA profile obtained from blood evidence collected at the crime scene in 1979 was entered into CODIS, a national DNA database. Unfortunately, there were no matches found at the time. Fast forward to October 2022, when the DNA profile was re-evaluated using Forensic Investigative Genealogy. This renewed effort led investigators to a new lead, finally identifying the source of the blood at the scene. However, this individual was ultimately eliminated as a suspect in Mena’s homicide. Undeterred, investigators created a second DNA profile from items that were directly connected to Mena. This profile was once again entered into CODIS, and the results were astounding. Samuel Silva, born on March 29, 1961, was positively identified as a match. Further investigations into Silva revealed a disturbing history, including a lengthy criminal record involving sexual assault and violent crimes. Silva had formerly resided in Sunnyvale before moving to Colorado, where he passed away in 2008. After extensive efforts, including gathering additional evidence of Silva’s involvement and conducting numerous interviews, the Sunnyvale DPS officially announced the closure of the cold case on October 26, 2023, just one day before the 44th anniversary of Mena’s tragic death. Samuel Silva has been named as the perpetrator of this heinous crime. The Sunnyvale DPS expressed their gratitude to Mena’s family for their patience and cooperation throughout the investigation. They also extended their appreciation to multiple agencies, including the Santa Clara County District Attorney’s Office Cold Case Unit, Santa Clara County Crime Laboratory, and various law enforcement agencies in Colorado, for their collaborative efforts in bringing closure to this long-standing case.
