San Jose Father Faces Charges in Tragic Opioid Overdose of Baby Daughter
In a devastating turn of events, a father in San Jose has been charged in connection with the fatal opioid overdose of his three-month-old daughter. The Santa Clara County District Attorney’s Office revealed that the baby, named Phoenix, tragically lost her life after ingesting methamphetamine and fentanyl. The father, 38-year-old David Anthony Castro, now faces charges of felony child neglect and possession of a controlled substance.
The discovery was made by officers from the San Jose Police Department who responded to a call at an apartment on Spinnaker Walkway on May 13, 2023. They found Phoenix unconscious in an apartment “littered with opioids,” according to the DA’s office. The kitchen area was filled with broken glass pipes, aluminum foil, and fentanyl. Shockingly, a baby bottle filled with liquid was discovered next to the glass pipes on the kitchen counter. Narcan, a drug used to revive individuals from fentanyl overdoses, was also found at the scene.
Despite efforts to save her, Phoenix was pronounced dead. It is a heartbreaking situation made worse by the fact that her mother, who was not present at the time of the baby’s death, tragically succumbed to an overdose just last month.
David Anthony Castro, now facing charges related to the death of his own child, is scheduled to be arraigned on Monday at 1:30 p.m. in Department 43 of the Hall of Justice in San Jose. If convicted, he could be sentenced to prison.
The District Attorney, Jeff Rosen, expressed his profound disbelief at a parent’s ability to recklessly cause the death of their own child. Rosen emphasized the importance of holding individuals accountable for such heartbreaking tragedies, reinforcing the responsibility of the legal system to seek justice.
